AVOID CONSERVATORSHIP
If you become incapacitated and you do not have an effective Durable Power of Attorney a court will appoint someone to take over your finances and legal affairs. This person is often a lawyer and a stranger to you and your family.
You avoid this with a properly prepared trust and/or Durable Power of Attorney. This must be done while you are competent. Once a person becomes incompetent the court must step in and take over for you.
